2. Definitions
“Services”: Refers to all products and services provided by 529 Marketing, including but not limited to AI voice agents, AI chatbots, marketing automation, and digital marketing solutions.
“Client Data”: Any content, information, or materials provided by the client, including training data used for AI models.
“AI Systems”: Any proprietary or third-party AI technologies used in the Services.
“Third-Party Integrations”: Platforms or software not owned by 529 Marketing, such as GoHighLevel.
3. Scope of Services
We provide digital marketing services powered by AI, including:
Custom AI voice agents
Chatbots
Automated workflows
CRM setup and campaign execution
We reserve the right to update, change, or discontinue any part of the Services with prior notice.
4. AI-Specific Limitations
While we strive to deliver high-performing AI systems, results may vary.
AI responses are generated based on available data and algorithms and may not always be accurate.
You acknowledge that AI-generated content may contain errors, require review, and should not replace human oversight.
AI outputs do not constitute legal, financial, or medical advice.
5. Payment Terms
Monthly Recurring Fees: Billed at the beginning of each billing cycle.
Setup Fees: One-time fees may apply for initial implementation and onboarding.
Late Payments: A 5% late fee will apply to payments more than 7 days overdue.
Non-payment: May result in suspension or termination of services.
6. Client Responsibilities
Provide accurate and lawful training data/content for AI systems.
Ensure necessary permissions and rights to use all submitted data.
Cooperate with our team during implementation, training, and testing.
7. Intellectual Property
All custom AI configurations and code developed by 529 Marketing remain our intellectual property.
You own your business data and any original content provided by you.
Use of our proprietary systems outside of our platform is prohibited without written permission.
8. Data Privacy & Security
We implement standard industry practices to protect client data.
We do not sell your data.
You are responsible for maintaining the confidentiality of any access credentials we provide.
9. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed the total amount paid by you in the past 3 months.
AI-generated errors or miscommunications are not grounds for liability.
10. Termination
Either party may terminate with 14 days’ written notice.
No refunds are provided for partial months.
We may terminate immediately for breach of these Terms or unlawful use of the Services.
11. Dispute Resolution
Any disputes will be resolved through binding arbitration in the state of Virginia.
Each party will bear its own costs.
Arbitration shall be conducted under the rules of the American Arbitration Association.
12. Service Level Agreement (SLA)
We aim for 99.5% uptime excluding scheduled maintenance or third-party downtime.
Support response within 24 hours during business days.
SLAs do not apply to services interrupted by third-party platforms.
13. Third-Party Integrations
We may integrate with third-party platforms like GoHighLevel.
You agree to also be bound by the Terms of those platforms.
We are not responsible for any downtime or data loss caused by third-party services.
14. Refund Policy
Setup Fees are non-refundable.
Monthly service fees are refundable only if services were not rendered due to our fault and within 7 days of the charge.
No refunds for unused time or early cancellations.
15. Indemnification
You agree to indemnify and hold harmless 529 Marketing, its employees, and affiliates from any claims, liabilities, or damages arising from:

16. Compliance with Communication Regulations
You are responsible for ensuring compliance with all relevant communication laws (TCPA, CAN-SPAM, etc.).
Do not upload contact lists without consent.
We provide tools, but not legal compliance guarantees.
Violations may result in immediate termination.
By providing your contact information, including your phone number, you affirm that you have provided express written consent to receive SMS communications from 529 Marketing. These messages may include promotional content, reminders, and updates. You may opt out of SMS communications at any time by replying STOP. Message and data rates may apply.
17. Changes to Terms
We may update these Terms at any time. We will notify you of major changes via email or your client dashboard.
